THIS COVENANT

Purchase & ownership of land within Tato Estates represents your agreement between you and Tato Estates, owned and managed by Matttt Li.  This covenant documents that agreement.

This agreement is designed to protect your INVESTMENT.  This document is designed to inform you in the simplest way possible, the way land ownership works here.

PRICES

Base Purchase Rate from Matttt Li = 1.62 L/sqm. (Price may vary on resale)

Tier Rate = 1.62 L/sqm. per month (which is 6,600 Lindens for a 4096)

Size m2 = 4,096

Prims = 937

Purchase Price = 6,600 L$ (not active during sale)

Monthly Tier = 6,600 L$

Larger size parcels are actually multiple 4,096m parcels.  Their prims, purchase prices, and monthly tier are calculated as multiples from the base rate.  For example, an 8,192 parcel is actually two 4,096 parcels.  Therefore, the prims are two times 937 = 1874.  The purchase price & monthly tier are also two times the numbers in the list above.

PURCHASE – As soon as you reserve your land, contact Matttt Li to pay any remaining purchase price (if any) and the first monthly fee.  He will update the records and avoid reclaiming the land.  The full purchase price and first month tier is due immediately upon purchase.  Failure to pay the full purchase price and the first month tier immediately will result in the land being reclaimed.  Ownership is not established until the full purchase price and first month tier is paid.

SCAMS – If you claim the land for the reserve amount and then put the land up for sale without paying the full purchase price and monthly tier, then the land will be reclaimed, your avatar will be banned from the estate, and the name of your avatar will be announced to the community of SIM owners so that they may ban your avatar from their SIMs also.

LAND SIZE

* The base land size is 4096 square meters.  Ownership is always based on one or more parcels of 4096 sq. meters.  With approval of the SIM owner, parcels may be combined to represent parcels that are multiples of a 4096.  However, they cannot be subdivided into smaller parcels.  When in doubt, this agreement is based solely on a single or multiple 4096 parcels.

INVESTMENT POLICIES

* You are purchasing initial access to a parcel of land and subscribing to a monthly tier on that land.  The purchase price is a setup fee to gain initial access.  Once you have ownership of the land, you can sell your access to other players.

* Sub-leasing or renting is only allowed on commercially-zoned land.

* Your purchase gives you complete ownership of the land.

* Each 4096 parcel has 937 prims, the maximum number of prims possible for a 4096 parcel.  Prim allowance is not artificially inflated by double selling unused prims from other parcels.  We don’t double-book our prims.  Also, temp rezzers are not allowed.

* Premium accounts are not required

* If land is purchased directly from Matttt Li for a price that is lower than the base purchase price (published above in PRICES,) then the remainder is due immediately upon purchase.

* If the land is purchased directly from Matttt Li, and the ‘buy’ price is less than the prices stated in the table above (see PRICES,) then the initial ‘buy’ price is a reserve or a holding fee to hold the land for no more than a few minutes while you arrange to pay the complete purchase price and first month tier.  The balance is due IMMEDIATELY after you claim the land.

* The first month fee (tier) published above is due immediately upon purchase of any parcel from Tato Estates.

** e.g. Buy 4096m of land at $L 1 and immediately pay Matttt Li $L 6,600 to cover the  the remainder of purchase price plus $L 6,600 for the first month tier.  Your reserve fee of $L 1 will be returned.

* Purchases from existing land owners allow for any existing tier paid to continue from one owner to the next.

** e.g. Buy land at $L 20,000 from John Doe.  However, if John Doe paid the tier 15 days prior, then the tier for the land would not be due for approximately 15 days.

* Monthly payments are paid directly to Matttt Li and tracked within the transaction history of Matttt Li’s account.  Payments to any other avatar or account are not recognized unless pre-arranged by Matttt Li.  Payments are to come from the land owner and no other avatar unless pre-arrangements have been made with by Matttt Li.

* Paypal payments are generally not conducted due to Paypal’s innability to retain confidentiality.

* Within the rest of the terms of this agreement, you keep the land as long as you keep the monthly fee payments current.

* You become the parcel owner when you buy the land, with owner controls over the land.

* You may resell the land as long as you are listed here – http://tatoestates.com/validowners (which requires that you have paid your full purchase price and are current on your monthly fee)

* If a payment is late, the land may be immediately reclaimed.

* If you break the agreements in this document, the land may be reclaimed.

* If land is reclaimed, it is returned to its original state and no refund is issued.

* You are free to re-purchase land after it has been reclaimed (unless otherwise notified.)

* No refunds.

* Management may establish an automated payment system in the future.

LAND POLICIES

To protect your INVESTMENT here are some simple policies that we insist that you follow.  Your purchase and ownership of land here represents your agreement with these rules.  Failure to respect these standards will result in the property being reclaimed.

ZONING

There are 2 types of zoning in Tato Estates, Residential & Commercial/Residential.  Residential is for single family living, building & architecture with businesses that only fit within a single family residential theme.  Commercial/Residential zoning is for either commercial or residential use, at the discretion of the land owner.

RESIDENTIAL ZONING – Residential properties are zoned as single-family residential.

Businesses within Residential Zoning – Keeping with a residential theme, only modest vendors are allowed within the walls of a residential structure as long as they are not visible outside your parcel.  Please do not post any unsightly billboards or signs.  Any and all signage visible outside of your parcel is subject to management approval.  The appearance of the lot must follow a residential theme (e.g. paintings inside an art gallery contained within a house.)  No casinos, camping, or clubs.

COMMERCIAL ZONING – Commercially-zoned properties are primarily for businesses and may allow for residential living when residents are willing to tolerate businesses nearby.  Signage within a commercial zone must be subtle and artistically blend with the structure; must not be flashy; must not rotate; or otherwise obnoxiously interrupt the view across the landscape.

Commercial structures must blend well with the landscaping and represent a country or suburban theme (e.g. buildings or plazas with lots of foliage, or even single-family residential buildings.)

ALL ZONES

Scripts – Scripts are allowed as long as they do not disturb the peace or take up too much bandwidth.  Use of highly active scripts is at your own risk.  They may be removed if they are a problem.

Landscape – This is a country or suburban resort area, not industrial, town or city.  Architecture and landscaping must be kept sympathetic to the area.  Beyond that, your property is your own to landscape as you wish.  You may terra-form your parcel, but must do it in a way that is sympathetic with the land and neighborhood around it.  In other words, please blend your land and landscaping so that it fits with others around you.  Structures should not overhang into an adjacent parcel without the explicit permission of the neighboring owner.

View Menu > Property Lines (Ctrl+Alt+Shift+P) will enable you to see the parcel boundaries.

Crowding – Please do not crowd your neighbor or create a crowded condition with your architecture, terraforming, and landscaping.  The land is meant to be open.

Walls & Screens – These are generally not allowed on the property boundery.  They interrupt the flow of the land and result in land that does not fit with the land around it.  The land must be kept open so that the view is not interrupted by a wall or screen at the boundary.  This also applies to buildings.  Make sure that no significant large portion of your building (e.g. your house or your shop) is too close to the boundery of your property.  All buildings should allow for some natural yard space between it and the property lines.  Here is a good guideline.  If a ‘Pine Tree – Evergreen’ can be planted on the other side of your property line, and the branches extend into the building, then the building is too close to the boundery.  Exceptions are made when two neighbors on each side of a property line agree on a structure.

Architecture – Residential houses should appear residential.

Homes, outbuildings, and other builds must be kept within the confines of one’s own land except with the explicit permission of the other land owner.

Airborne structures are only permitted higher than 300m.

All buildings at ground level must be no more than 4 stories tall.

No eye sores please.

Pedestrian Traffic – Allow for pedestrian traffic.  People need to be able to travel across the land surface without being blocked.  Please avoid permanently blocking access to your entire parcel.  Security is okay to use to prevent unwelcome people from lingering on your parcel.

Security – No red bars.  Do not restrict access to your parcel using the ‘Access’ tab within About Land.  If you need security, use some other 3rd party system.  Allow people enough time (at least 30 seconds) to walk by before your system removes them.

Water – When the ground surface is close to water level, you can dig down and create waterways on your land if you want.  If you do that, please blend with any waterways on the land adjacent to yours.

Names & Descriptions – You may name your land & set your description any way you like, following SL policies.

Music & Media – You may set music & media on your land to any URL station.

Peace – Please do not disturb the peace.  This land is a safe place to live and play, so please no harassment, stalking, littering or other anti-social behavior.  You are responsible for the behavior of any guests that you invite to the Region.  Objects that automatically shout can be especially annoying to your neighbors.  So, please do not use them.

Combat – This is a combat free zone.  All parcels must retain safety option on.

Maturity – This is a mature region.  However, please keep your genitals out of the public eye.  There may be younger family members who have visibility from within your neighbor’s land.

Resources – Island bandwidth is not limitless.  Do not do things that eat up all the resources.  No Sandboxes.

Purchase – When buying your land, contact Matttt Li and make sure that your purchase price and first month is paid in full.  Failure to do this will result in the land being reclaimed.  You may not resell your land until the purchase price and the first month is paid in full.

Management – Tato Estates Management reserves the right to intervene as necessary if any of the above rules are not followed and the situation becomes a problem.  This may include removal or adjustment of scripts & objects, the adjustment of terraformed land, banning avatars from the estate, and reclaiming land.

OTHER POLICIES

* Management reserves the right to change this agreement in the future with as needed.

* The land is provided on an ‘as is’ basis to residents. We endeavor to provide a pleasant experience in line with the expectations of our customers but can offer no guarantees of satisfaction.

* Tato Estates reserves the right to evict for non-compliance or non-payment. No refunds will be given.

* All land owners must maintain membership in the SIM group, a group that shall be used for communications by management.

* We always strive to be fair.

* We are strict in the enforcement of policies.  We don’t tolerate breaks in policy that annoy other residents.  Having said this, we tend to rely on residents working with each other.

* This agreement is developed for the purpose of playing an online game.  Nobody is liable for any reason in real life.  Everyone reserves the right to leave if they have to.
